This Rivaux Watches webstore is operated and owned by Rivaux B.V. (“us”/”our”/”we”)

The following terms and conditions apply to the use of this webstore. By accessing this webstore and/or placing an order, you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may choose not to use or access this webstore. All other terms and conditions including those in any order submitted by you are expressly excluded and shall have no effect. Read this terms and conditions carefully.

1. Description of products and liability

The Rivaux Watches webstore and the products in this webstore have been prepared with the utmost care and skill. We will take all reasonable care to ensure that all details, descriptions, images and prices of products appearing on the webstore are correct at the time they were entered into the system. Although we aim to keep the webstore as up to date as possible, the information including product descriptions appearing on the webstore at a particular time may not always reflect the position exactly at the moment you place an order as permitted by mandatory law. We also cannot warrant that the webstore is always available. We cannot be held liable for damage resulting from or related to any use of this webstore or the information in it. Using the webstore is always at your own risk.

Any warranty reclamation you may have in relation to ordered products must be initiated within two years (see 4.Warranties, repairs, returns and refunds) after the claim.

2. Placing an order

By placing an on-line order for the product you have put in your "shopping cart", you are offering to buy them at the price and on the terms in this webstore. We will send you an e-mail acknowledging that we have received your order (Acknowledgement of Receipt).

We will confirm your order by sending you an e-mail that the product has been sent out (Order Confirmation). The agreement between you and Rivaux B.V. will only be formed when you have received this Order Confirmation. If we do not accept your order for any reason, we will inform you by e-mail.

You warrant that you are at least 18 years old and are legally capable of entering into binding agreements by placing an order through this webstore and that all data you provide us through the webstore or otherwise is accurate.

In the event of supply difficulties or if a product is no longer in stock, we will inform you and reimburse any payment that you have already made.

3. Prices and payment

The prices in the webstore are inclusive of VAT, please note that the price listed as the total of your order is always the value that you’ll be charged.

Rivaux Watches is never responsible for any custom duties, if custom duties are applicable these are for your own account.

Shipping and delivery within the EU is free of charge. Shipments outside the EU will be charged with a small fee. These shipping charges are automatically calculated when checking out..

Payments in our webstore are handled by Ogone, our PSP (= Payment Service Provider) (for detailed information see www.ogone.com). Ogone uses SSL (=Secure Socket Layer) technology to protect personal information that is transmitted across the Internet. During the online ordering process you will receive instructions for your selected method of payment. We accept payments by credit card (Mastercard, VISA) or iDeal (only available in the Netherlands).

4. Warranties, repairs, returns and refunds

Warranties
All Rivaux Watches come with a 2 year manufacturer’s warranty. Warranty terms and conditions apply to each item and can be found in the accompanying documentation. If your timepiece fails to operate to its specification during the warranty period, we, Rivaux B.V., as the original supplier of your product, or an authorized Rivaux Watches repair center, depending on your location, will repair or, if necessary, replace it.

Repairs
Rivaux Watches International Guarantee: If during a period of 2 years from the date of purchase your timepiece becomes defective due to faulty materials or workmanship we guarantee to replace free of charge the defective part providing:

  1. The timepiece has not been damaged due to accident, incorrect usage, wear and tear or neglect..
  2. The timepiece has not been damaged by water or any other fluid.
  3. Repairs are only carried out by an accredited Rivaux Watches repair center using correct and original spare parts.
  4. That a correctly completed guarantee form or proof of purchase form is provided. Failure to enclose the proof of purchase or a date stamped guarantee could result in a charge being made.
  5. The guarantee does not apply to leather straps or glasses. (unless it can be established indisputably that the damage has been caused by a production failure)
  6. Guarantee forms or proof of purchase forms which have been altered, falsified or tampered with will not be honoured.

 

If the problem is not covered by the warranty or if your warranty has expired, charges apply.

Free estimate(s) will be given on chargeable repair(s). On this estimate, you will be able to indicate whether you agree to the repair work (at the given price). If you decline the repairs we will send the timepiece back to you as soon as possible. Shipping costs could be at your own account.

When returning your timepiece for a pitstop (service) please pack it in a sturdy box (you may use the original presentation case), provinding you also use outer packaging for maximum protection.

Send it by registered and insured post with your guarantee form or proof or purchase form and reason for its return.

Include your name, return address, e-mail address and daytime telephone number.

Return of a product and refunds
If you find the product to be defective at the time of the delivery, please promptly contact us per e-mail on returns@rivauxwatches.com, presenting us with details of the product and its defects. (in case of damage please also include a photo of the damage in your e-mail) We will then instruct you how to proceed.

If for any reason you are unhappy with the item you have bought, you may return it to us within 14 days without giving any reason for such return and in accordance with the instructions below for a full refund.

Please note that the product must always be returned undamaged, by registered and insured post, in it’s original presentation case and outer packaging (in its original condition) including any accompanying accessories and with the original invoice/packing slip. You can find our return address in the accompanying documentation of your order.

Please note that you will be responsible for the direct cost of returning the goods by registered and insured post.

To exercise your so called right of withdrawal, you must inform us of your decision to withdraw. by e-mail within the withdrawal period mentioned above.To meet the deadline, it is sufficient for you to send your communication concerning your exercise of your right of withdrawal before expiry of the withdrawal period. We will sent you an acknowledgement of receipt of your withdrawal notification by e-mail as soon as possible.

If no instructions for return were sent with your product during the withdrawal period and, if you timely exercised your right of withdrawal, thereafter until you return the product to us, you shall take reasonable care of the product(s) whilst it is in your possession. We reserve the right to retain compensation from the reimbursement if the returned product has been damaged or has been used beyond what is necessary for your verification of the product.

We may withhold reimbursement until we have received the product back from you or you have supplied sufficient evidence of having sent back the product in good order, whichever is the earliest.

5. Dealing with complaints

If you have any complaints we aim to respond to you within five working days, although in the majority of cases we deal with complaints as soon as we receive them.

6. Miscellaneous

These Terms and Conditions apply to Dutch law.
Any disputes in connection with these Terms and Conditions shall be submitted to the court which has jurisdiction according to Dutch law.
